Hermès Filed the Trademark Last Month

Hermès, a France-based luxury brand, filed a Web3 trademark application last month to allow its name to be reserved for use cases in the cryptocurrency, Web3, metaverse, and NFT categories. A Washington-based Web3 trademark attorney, Michael Kondoudis, reported this development on August 31st, days after Hermès filled the trademark. The case is still under litigation.

Once this trademark has been approved, Hermès will have the exclusive right to set up activities and services using its name. This includes creating digital currencies, tokens, and collectibles, launching virtual retail services for its brand products, using technology user authentication services, and providing financial services. This move is possibly connected to the latest issue where an NFT artist minted blurry images of Hermès Birkin bags and tried to sell them. Hermès responded by suing the concerned individual for copyright infringement, but the court dismissed the case, saying that the artist may be working ‘within their first amendment right.’

Other Companies Filing Web3 Trademark Application

Hermès is not the first company to file a trademark application. Two months ago, Hyundai, the South Korea-based automobile company, filed another trademark application to cover NFTs and VR. The development came after it completed its ‘metamobility’ campaign alongside the NFT set.

Miley Cyrus, a famous singer and founder of the Miley Smiley organization, registered NFT and metaverse trademarks in her name for many virtual products such as drinks and clothing. Recently, a racing company – Formula 1 – filed for trademarks before a Las Vegas race. This ace is expected to cover physical and digital items and virtual currencies and their trading.

This development by Hermès is a potential move into the Web3 space and is a signal to customers and potential clients about their future intentions.
